1. The Terms

1.1 Acceptance of Terms “Wells Physical Therapy Dba Nutritional Physical Therapy” is the owner and operator of the Nutritional Physical Therapy Website located at www.nutritionalphysicaltherapy.com and www.nutritionalphysicaltherapy.org, among other websites owned and operated by Nutritional Physical Therapy. This Terms of Use (the “Agreement”) governs access to and use of the Nutritional Physical Therapy Website and its online educational services. Access to and use of the Nutritional Physical Therapy Website is subject to Your acceptance of this Agreement. You agree to abide by all terms and conditions of this Agreement by Your accessing the Nutritional Physical Therapy Website and/or by Your continued use of the Nutritional Physical Therapy Website.

1. “Nutritional Physical Therapy Website” means the Nutritional Physical Therapy Website accessible through the URLs www.nutritionalphysicaltherapy.com, www.nutritionalphysicaltherapy.org, or www.nutritionalphysicaltherapyeducation.com, among other websites owned and operated by Nutritional Physical Therapy.

2. “Nutritional Physical Therapy” means Wells Physical Therapy Dba Nutritional Physical Therapy in the State of Florida, United States of America.

3. “Parties” means Nutritional Physical Therapy and You, collectively.

4. “Party” means either Nutritional Physical Therapy or You.

5. “User Profile” means an account or profile registered by You on the Nutritional Physical Therapy Website.

6. “You,” “Your,” and/or “User” means any individuals and/or entities visiting and/or otherwise accessing the Nutritional Physical Therapy Website for any reason.

7. “Content” means all information, data, text, software, audio, photographs, graphics, videos, messages, tags, course materials, or other materials posted and/or displayed on or via the Nutritional Physical Therapy Website.

8. “Personal Information” means, without limitation, any information that identifies or describes an individual, including his or her name, professional licensing information, physical description, age, gender, home address, email address, telephone number, or education.

9. “Licensor” or “Licensors” means the individuals or entities who have licensed their lecture content or educational materials to Nutritional Physical Therapy.

10. Website Use & Intellectual Property

2.1 Content Ownership Nutritional Physical Therapy is the owner of all Content posted on or otherwise accessible at or via the Nutritional Physical Therapy Website including logos, design, text, graphics, images, video content, and downloadable materials. Unless otherwise agreed in writing, You are granted a limited, non-exclusive, non-transferable license (without the right to sublicense) to access and view the Content for Your personal, educational, non-commercial use only. Any copying, reproduction, recording, retransmission, sharing, or republication of all or part of any Content found on the Nutritional Physical Therapy Website is expressly prohibited without prior written consent from Nutritional Physical Therapy.

2.2 Trademarks & Protected Titles Portions of the Nutritional Physical Therapy Website and materials contain registered trademarks and protected branding. Use of Nutritional Physical Therapy trademarks does not grant You any right, title, or interest in said marks.

2.3 Certified Nutritional Physical Therapist (CNPT®) Credential Protection The use of the term Certified Nutritional Physical Therapist (CNPT) includes the words "Physical Therapy" or "Physical Therapist," which are legally protected terms in most states and international jurisdictions.

Earning a certificate or completing courses through Nutritional Physical Therapy does NOT grant a non-physical therapy licensed person the use of the Certified Nutritional Physical Therapist (CNPT®) credential or any other form of PT, physical therapy, or physical therapist's title or expressed services. The CNPT® credential can ONLY be used by individuals actively licensed, registered, or chartered to practice as a physical therapist. Other healthcare professionals may not use the credential or label themselves as a PT or physical therapist, or claim to be providing physical therapy with the credential. 2.4 Copyright Complaints If You believe that any Content on the Nutritional Physical Therapy Website infringes upon any copyright which You own or control, You may send a notification of claimed infringement to legal@nutritionalphysicaltherapy.com.

2.5 Course Access & Availability 2.5.1 Access Terms: Course access duration is specified at the time of purchase. Individual course purchases grant access for one (1) year from date of purchase unless otherwise stated. Course bundles designated with "Lifetime Access" grant active access to the enrolled course materials for as long as the course is maintained and hosted on the Nutritional Physical Therapy platform. 2.5.2 System Availability: Nutritional Physical Therapy reserves the right to update, modify, or discontinue courses or update platform architecture as necessary.

2.6 Technical & System Requirements You are responsible for obtaining and maintaining all computer hardware, software, and internet connectivity needed to access the Nutritional Physical Therapy Website. High-speed broadband internet and a modern, updated web browser supporting HTML5 video streaming are required to view video and multimedia course content.

3. User Accounts & Security

3.1 Account Responsibility Users registering an account or profile are responsible for maintaining the accuracy of their profile information, including professional license details required for continuing education reporting. You are responsible for all activity occurring under Your account.

3.2 Password Confidentiality & Anti-Sharing Policy You must maintain Your own secure password. Account credentials and course access may NOT be shared with third parties. Sharing account access, login details, or course videos with unauthorized users will result in immediate termination of Your account without refund.

4. Disclaimers & Continuing Education Notice

4.1 General Disclaimer The content provided on the Nutritional Physical Therapy Website is for educational and informational purposes only. Content is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. Nutritional Physical Therapy makes no guarantees regarding uninterrupted access or that course material will be completely error-free.

4.2 Medical & Clinical Disclaimer Exercises, nutritional protocols, and clinical information provided in course materials are intended for professional educational purposes. IT IS THE RESPONSIBILITY OF THE TREATING PRACTITIONER, RELYING ON INDEPENDENT CLINICAL EXPERTISE AND KNOWLEDGE OF THE PATIENT, TO DETERMINE THE BEST TREATMENT, NUTRITIONAL RECOMMENDATIONS, AND METHOD OF APPLICATION FOR ANY PATIENT. Nutritional Physical Therapy assumes no liability for clinical outcomes, injury, or damages resulting from the application of course content.

4.3 Legal Notice & CE Credit Accreditation Courses eligible for CE credit for physical therapists (PTs) or physical therapist assistants (PTAs) are approved by the Florida Board of Physical Therapy Association (FPTA). Online-only courses are approved by the Florida Board of Physical Therapy Association only. CE approval for PTs will be sought and pre-approved in the state an onsite course is held only if pre-approval is required in that specific state. Some courses may not be eligible for CE credit.

The Company (Wells Physical Therapy Dba Nutritional Physical Therapy) is not currently a BOC (Board of Certification for Athletic Trainers), AOTA (American Occupational Therapy Association), or CME (Continuing Medical Education) provider. A certificate of completion will be issued upon successful completion of qualifying courses. Accreditation of any course does not necessarily imply that the FPTA supports the views of the presenter or sponsors.

4.4 State Reciprocity & Registrant Responsibility State regulations governing continuing education change regularly. It is the participant’s responsibility to verify if their specific state licensing agency accepts reciprocity with the Florida Board of Physical Therapy Association. If you have questions pertaining to individual state requirements, you must consult your state licensing board's website and research applicable regulations.

Course participants are solely responsible for submitting their own continuing education certificates and fulfilling additional requirements independently per their licensure board regulations. Nutritional Physical Therapy accepts no liability for information provided or for the rejection of continuing education credits by any state board or governing authority.

5. Limitation of Liability

In no event shall Nutritional Physical Therapy, its officers, members, directors, employees, agents, or licensors be liable to You or any third party for any direct, indirect, incidental, special, or consequential damages arising out of the use of or inability to use the Nutritional Physical Therapy Website or courses. Nutritional Physical Therapy’s total cumulative liability in any event is strictly limited to the total amount actually paid by You for the specific course or service purchased.

6. Billing, Fees, & Refund Policy

6.1 Payment Authorization You agree to pay all fees associated with courses or bundles purchased. You expressly authorize Nutritional Physical Therapy to charge your designated payment method through our secure third-party payment processing gateway. Nutritional Physical Therapy does not directly store full credit card account numbers on its servers.

6.2 Refund Policy We provide full refunds for up to 24 hours after course(s) are accessed. After 24 hours from initial course access, no refunds will be offered under any circumstances due to the immediate digital delivery of course materials, intellectual property, and continuing education certificates.

7. Indemnification

You agree to indemnify, defend, and hold harmless Nutritional Physical Therapy, its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, losses, expenses, or damages (including reasonable legal fees) resulting from Your violation of this Agreement, unauthorized credential usage, or misuse of course content.

8. Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal dispute or claim arising out of or relating to this Agreement shall be resolved through binding arbitration administered in Florida in accordance with the commercial arbitration rules of the American Arbitration Association.

9. Miscellaneous

If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect. No waiver of any breach of this Agreement shall constitute a waiver of any prior or subsequent breach.
